Divorce
You can apply for a divorce only if you have been separated for 12 months or more. Australia’s divorce system is no fault based. This means that the behaviour of each party prior to separation is not relevant, only that the relationship has irretrievably broken down. In order to end a marriage, a divorce needs to be filed and granted by the Court. We can prepare and file a divorce application for you quickly and cost-effectively. We can also advise you on your legal rights and responsibilities in relation to related matters such as property settlement and child custody.

Children And Parenting

Unfortunately children can sometimes be the main victims following the dissolution of a marriage or de facto relationship. For this reason, it is important to have arrangements in place for your children that are in their best interests. Generally we will be able to negotiate these arrangements informally with your ex-partner, the arrangements of which are then embodied in parenting orders. If informal arrangements cannot be agreed, then we will assist you to obtain parenting orders through mediation or litigation.

Property Settlement
After the breakdown of a marriage or de facto relationship, it is necessary then to divide your assets. Often it is difficult to make a well informed decision on the division of assets when under emotional stress and pressure from an ex-partner. Let us be the voice of reason that ensures your rights are protected during this difficult time and that you achieve a fair property settlement. Take note that there are strict limitation periods in place; property settlement proceedings must be commenced within 1 year of the divorce, and de facto property settlement proceedings must be commenced within 2 years of separation.
